GUARDIANSHIP:

On June 13, 1786 the judges of the Orphans Court in Frederick Co., Maryland appointed John Clabaugh to be the guardian of the orphan Cumberland Ferguson. A bond of 38 pounds 18 shillings 8 pence was put up by John Clabaugh, Abraham Hill and John Eckus/Eckiss. Cumberland was then about 15 years old.

In 1850 Cumberland Fergusson (80, Md) and Mary E. Fergusson (79, Md) are living in Osage Co., Missouri in the household of their son John C. Fergusson (34, Tn, farmer), his wife, and 4 children. Reuben Vaughan (46) and George W. Vaughan (34) live nearby.


General Notes: Wife - Mary E. Clabaugh

Part of the evidence that Mary's maiden name was 'Clabaugh' is that the middle name of her son was 'Clabaugh'. Also on page 14 of The Clabaughs by Betty Harrell we find the following:

"In 1786 John Clabaugh, in his 30s, was appointed guardian of a Cumberland Ferguson, age about 14, with the bond being put up by Abraham Hill and John Eckus. Young Cumberland was the only child of Robert Ferguson of Taneytown, who died in 1773 leaving his baby son in the custody of the boy's mother. Robert appointed John Farguson of Pipe Creek and John McAlister of Taneytown his executors; witnessing the will were Abraham White, Samuel Wilson and an adult Cumberland Ferguson. It is believed that this Robert Ferguson and the adult Cumberland Ferguson were brothers of John Clabaugh's wife Margaret; however, no mention is made of them nor Robert's son Cumberland in the will of Margaret's father Samuel Ferguson in 1789. The adult Cumberland was probably the Cumberland Ferguson who on July 28, 1777, was paid £.15.0 for 32 days joiner (carpenter) work on the sloop Molly."

We can be sure that Robert Ferguson was in some way related to John Clabaugh's wife Margaret Ferguson. The boy probably became part of John Clabaugh's household, and a marriage with one of his daughters would have been a natural result.
