IS JOSEPH HIS FATHER?

Numerous transactions involving the landed estate of Joseph Hinds make it clear that John B. Hinds is an heir of Joseph Hinds, but in what way? In his own right or by right of his wife, Mariah Hinds? It is impossible to tell on the basis of these transactions, but the minutes of the probate court in Brazoria, Texas concerning the estate of Joseph's brother Levi make it clear that John B. is one of Levi's sons. Mariah then is Joseph's daughter.

COUSINS:

John B. Hinds and his wife Mariah Hinds are first cousins. Five of their children married cousins. Yeatman, Joseph G. and Benjamin T. married a first cousin. Rhoda M. and Matthew W. married a third cousin.

LAND:

The following tracts are in Wayne Co., Kentucky:

On January 21, 1837 John Bond and Mary Ann, his wife, sold to Allen R. West, Archibald Hinds, John B. Hinds, and Sarah Mercer for $600 all their right and claim to the estate both real and personal and mixed which belonged to them by virtue of the last will of Joseph Hinds, dec'd. (Bk G, pgs 171-72) John Bond's wife is Marian Brady. See Joseph Hind's will. On November 26, 1838 John B. Hinds sold his share to John S. Wray (Bk H, pg 8).

By 1850 John B. Hinds is living on the plantation which his wife's father bought from George Worley in 1816. Ownership is shared among numerous heirs. Several transactions in 1850 and in 1851 suggest that John B., his wife's brother Archibald, and his wife's brother-in-law John S. Wray are all trying to increase their share of the ownership of where they themselves live.

On October 22, 1850 Benjamin Hinds of Miller Co., Missouri sold to John B. Hinds of Wayne Co. for $50 "all my undivided right, title and interest in and to a certain tract or parcel of land lying and being in the County of Wayne and State of Kentucky and on the south side of Cumberland River, known as the George Worley tract and being the same upon which the said John B. Hinds resides at this time, the entire tract containing about 200 acres and which descended to the said Benjamin Hinds from the estate of Joseph Hinds, deceased". (Bk L, pgs 120-21)

On the same date (October 22, 1850) Richard C. Mercer and B. W. S. Mercer of Wayne Co., Kentucky, two of the heirs and legal representatives of their grandfather Joseph Hinds, dec'd, sold to John B. Hinds of Wayne Co. for $20 all their interest in the Worley tract. (Bk L, pg 124) The sellers are children of Nicholas Mercer and Sarah Hinds.

Also on page 124 of Book L is another deed from the same sellers to the same buyer with the same date in which the price is $54. The sellers are described as heirs of Sarah Mercer, dec'd, who was one of the daughters and heirs of Joseph Hinds, dec'd, late of Wayne Co., Kentucky, and what they sell is their undivided interest and share in the same tract described in a deed made the same day from Benjamin Hinds to Archibald Hinds, containing 206 acres more or less and whereon said Archibald Hinds then lived.

On January 8, 1851 John S. Wray and Elizabeth, his wife, of Wayne Co., Kentucky sold to John B. Hinds of Wayne Co. for $150 their interest in the Worley tract. The property is described by metes and bounds and adjoins that of Walter Emerson. They acquired the property as follows:

On the same date (January 8, 1851) Archibald Hinds and Martha Hinds, his wife, heirs of Joseph Hinds, dec'd, sold to John B. Hinds for $94 their 1/14 interest as heirs of Joseph Hinds, dec'd, and one fourth of the interest of John Bond and wife, heirs of Joseph Hinds, dec'd, which was purchased by Archibald Hinds from John Bond by deed, in and to a certain tract of land on the south side of Cumberland River on the left hand side of the big road leading from Monticello to Somerset, the same tract on which John B. Hinds then lived, and known by the name of the Worley tract, the boundaries of which are described in a deed executed that same day from John S. Wray to John B. Hinds, and containing 200 acres more or less. (Bk L, pgs 169-70)

DEATH:

John B. Hinds is on the Wayne Co. tax roll in 1873 and in 1874. In 1874 he has 1 horse worth $50, 1 child between 6 and 20, 6 hogs, 100 bushels of corn, and 15 bushels of wheat, and his net worth is $50. However 200 acres worth $800 is designated "same for his wife". Her name does not appear. John B. Hinds is not on the roll in 1875, and for the first time the name of Mary Hinds appears. She has 200 acres worth $1000, 1 horse worth $40, 1 child between 6 and 20, 4 hogs, and 35 bushels of corn, and her net worth is $1040. Presumably John B. Hinds died in about 1875.


General Notes: Wife - Mariah Hinds

WHO IS HER FATHER?

John B. Hinds, the husband of Mariah, is clearly an heir of Joseph Hinds (see notes under John B. Hinds for details) but in what way? -- in his own right or by right of his wife? The minutes of the probate court which settled the estate of Joseph's brother Levi make it clear that John B. is a son of Levi, and therefore we conclude that Mariah is Joseph's daughter. John B. and Mariah are first cousins.

WILL:

Mariah Hinds's will, undated but proved January 23, 1882, is on page 260 of Will Book A. There is an abstract in WILLS OF WAYNE COUNTY KENTUCKY 1802--1929. According to the abstract her surviving children are Elizabeth Susan Heath, wife of John Heath; Mathew W. Hinds; John B. Hinds; Woods Hinds; Gateman Hinds; Rhoda M. Hinds, wife of Henry Hinds; and B. T. Hinds. The will mentions her grandchildren, the children of Joseph G. Hinds, whose parents are dead.
