In 1860 Henry and Charles are living with their brother John/Jean Baptiste, who has married his father's widow. Also living with him are their half-siblings Louisa and Virginia. I cannot find Michael, Antoine, Edward, or Samuel in 1860 or in 1870.

On September 21, 1854 Mary Crely states to the Probate Court that Michael Crely died without a will and that she will make a perfect inventory of, and faithfully administer, the estate of the deceased. The heirs are Mary Crely, widow of the deceased; Aurore, wife of Joseph Brissett, Antoine, Eduard, Henry, Samuel, Charles, Louisa, Jenny, and George Crely, children of the deceased, who reside in St. Louis Co.; Michael Crely, son of the deceased, who resides in California; and John Crely, son of the deceased, who resides at Fort Leavenwerth. Signed Mary Creley.

On September 21, 1854 Mary Crely, as principal, and William Mithall and John B. James, as securities, are held and firmly bound unto the State of Missouri in the sum of $12000 for the faithful administration of the estate of Michael Crely, dec'd.

Letters of administration were granted to Mary Crely on September 21, 1854.

Presumably Michael Crely returned to Missouri from California soon after the death of his father because in 5 separate receipts for the payment of a fee of $.40 to the Probate Court he is referred to as the guardian of Edward, Henry, Samuel, Charles, and Antoine Crely, respectively. He pays a total of $2.00.

On March 5, 1856 Michael (X) Crely signs a receipt for $388.36 from Mary Crely, administratrix. This amount is "proceeds due Michael Crely, Jr. in partition sale of University vs. M. Crely, Jr. & others in St. Louis Land Court . . ."

On March 20, 1856 Mary Crely, as guardian of Henry Crely, is allowed $314.36 from the estate. A calculation is made and the amount $388.36 is mentioned. On the same date she is allowed the same amount as guardian for Samuel Crely and the same amount as guardian for Edward Crely.

Antoine Crely attained his majority September 14, 1856, and on December 1, 1856 he receives $347.36 ($314.36 plus interest) from the estate.

On December 30, 1857 John (X) Crely states to the Probate Court that Michael Crely died without a will and that he will make a perfect inventory of, and faithfully administer, the estate of the deceased. He says that the heirs are Mary Crely, widow of the deceased; Aurore, wife of Joseph Brissett, Antoine, Eduard, Henry, Samuel, Charles, Louisa, and Michael Crealy, children of the deceased, all of whom reside in St. Louis Co.; and George Crealy, "son of deceased who has died since the death of said deceased". On the same date John (X) Crely, as principal, and Louis R. Brand and Samuel James, as securities, are held and firmly bound in the sum of $2500 for the faithful administration of the estate.

On December 30, 1857 John (X) Crely, administrator de bonis non of Michael Crely, presents an inventory, including land, to the court. Five tracts of 45, 20, 45, 20, and 14 arpents are mentioned.

On July 25, 1860 John Piant receives $101.35 from John Crely, administrator, for Samuel Crely. On March 30, 1858 Edward (X) Crely receives from John Crely $101.35, $6.64 of which is in Pacific R. R. scrip. On March 24, 1860 Henry (X) Creely receives $310 from "Mary Creely as my guardian". Antoine Creely receives from John Crely $101.35 of which $6.65 is Pacific R. R. scrip.

In an undated statement John Crely says, "I John Crely one of the heirs of and Ad. de bonis non of Michael Crely dec'd having intermarried with Mary Crely my step mother, wife of said Michael Crely -- and being also guardian of Virginia or Jenny Crely and Louisa Crely two minor heirs of said estate -- charge myself as guardian of said minor heirs of their respective portions of said estate and also acknowledge satisfaction of the portions of said estate due to me in my own right and in that of my wife.

Aurore, Michael, John, Edward, Henry, and Antoine make a mark to sign documents.

At the September 1853 term of the Probate Court the attorney for Michael Crely petitions the court as follows:

The court has already rendered a judgment in favor of Baptiste Crely against the estate of Francois Crely in the amount of $280. The administrator intends to ask the court to approve a payment to him for $200. There are no assets available to pay the already approved claim of Baptiste Crely. The only assets of the deceased is his share of 4 contiguous tracts in the Common Field of St. Ferdinand having a total area of 170 arpents, and Michael Crely petitions the court for permission to sell the interest of Francois Crely in the property. Each tract is described as to dimensions and adjoining property owners and how Michael Crely acquired it. ". . . the interest of the said Francois Crely dec'd is in right of his Mother Angelique Wimette wife of your petitioner under marriage contract between the said petitioner & said Angelique Wimette dated 17 August 1821 & duly recorded in Book K p 342 by which in the event of their having children one half of the community went to these -- that she died leaving twelve children & consequently said Francois interest in the said several tracts is a twelfth of one half or one twenty fourth of the whole."

Three appraisers estimate that the 4 contiguous tracts are worth $30/arpent. The whole tract is thus worth $5100, and Francois's 1/24 interest is worth $212.50. Francois's interest was sold February 27, 1854 at auction at the northern front door of the St. Louis Co. courthouse. The high bid was $160 from St. Louis University. It appears to me that the University got full ownership of a 7 1/12 arpent tract taken from the 170 arpent tract. The expenses of the lawsuit and the sale were $61.20 (including $13.75 to advertise the sale, $1.00 apiece to the 3 appraisers, $2.10 apiece to 4 witnesses). $98.80 ($160-$61.20) remains. I don't know how much Baptiste actually received.
