The following will was signed 4 Aug 1773, and it was proved 11 Sep 1773 by the oaths of Abraham White and Samuel Wilson:
In the Name of God Amen I Robert Farguson of Tanny Town Frederick County Maryland, being weak in Body but of sound memory (blessed be God) do this fourth Day of August, one thousand seven hundred & seventy three make and publish this my Last Will and Testament in manner following (that is to say) First I recommend my Soul into the Hands of God who gave it and my Body I recommend to the Earth to be buried in a Christianlike, decent Manner according to the Descretion of my Executers. Also I give and bequeath unto my Son Cumberland the Sum of Fifty pounds Pennsylvania Money. I ___ him also to be left under his Mothers Care until he is twelv years of Age, and the Interest of his Money given to her yearly to help towards his maintainance & Education ~~ Provided that he is well used & taken Care of by his mother during said Time, if not I hereby impower my Executers to take him from her & provide for him, untill he is twelve or fourteen years of Age, then to be bound to larn whatever Trade he may make Choice of together with the Advice of my Executers; then from that Time the Interest with the principal is to remain in the Hands of the Executers till my Son arrives to the Age of twenty one then given to him ~~ But if my Son Cumberland dies before he is at the Age of twenty one; and my Wife then remaining to be my Widow, I order the one fourth part of his Money to be paid to her; but if married then the whole of his money shall be given to my nearest Friend & Relation. Also I give and Bequeath unto my beloved Wife Margaret Farguson; all and every article of my Household Furniture (Viz) Beds, Chairs, Dishes Potts &__ her side Saddle & my C__ ~~ I also order my Hern Saddle & Bridle to be sold and all my lawful Debts to be paid, & then if there is any Money left, after my Sons fifty ~~ Pounds and my Debts are paid, I order it to be given to my Wife. And I make and ordain John Farguson of Pipe Creek & John McAlister of Tanny Town both of Frederick County my Executors of this my Will in Trust for the Interests and Purposes in this my Will contained. In Witness whereof I the said Robert Farguson have to this my Said Will and Testament set my Hand & Seal the Day and year above written

GUARDIANSHIP:
On June 13, 1786 the judges of the Orphans Court in Frederick Co., Maryland appointed John Clabaugh to be the guardian of the orphan Cumberland Ferguson. A bond of 38 pounds 18 shillings 8 pence was put up by John Clabaugh, Abraham Hill and John Eckus/Eckiss.
