The following will was signed 21 May 1789 and was proved 27 Mar 1794 by the oaths of William and Hugh Farguson and then by the oaths of the two witnesses Henry Spalding and Abraham Hill. Non-standard spelling and punctuation have been preserved; paragraphing has been introduced.
In the Name of God Amen. I, Samuel Farguson senr of Frederick County and State of Maryland being in perfect health of and of sound and disposing Mind memory and understanding, considering the Certainty of death and the uncertainty of the time thereof and being desirous to settle my Worldly affairs and thereby be the better prepared to leave this world when it shall please God to call me hence, do therefore make and publish this my Will and Testament in the manner and form following that is to say First and principally I recommend my soul into the hands of Almighty God and my body to the Earth to be decently buried at the descretion of my Executors hereinafter named and after my debts and funeral charges are paid desire and bequeath as follows ----
Imprimis I give and begeath unto my daughter Mary Paxton ten pounds good and lawfull Money of this State
Item I give and bequeath unto my Son John two shillings lawfull Money of this State
Item I give and bequeath unto my daughter Ester Anderson Twenty pounds good and lawful Money of this State.
Item I give and bequeath unto my daughter Margaret Clabough Twenty pounds like Money
Item I give & bequeath unto my Son Henry Twenty pounds like Money
Item I give & bequeath unto my Son James twenty pounds like Money
Item I give & bequeath unto my Son Samuel two shillings like Money
Item I give & bequeath unto my beloved Wife Elizabeth three pounds good and lawful Money from each of my three sons Namely, Samuel, William and Hugh, yearly, to be paid to her yearly and every Year during her Natural life, But provided my sd wife should die before me, the said Money to be and remain in the Hands of my three Sons
Item I also give and bequeath unto my beloved Wife one feather Bed and furniture Viz the one she now commonly lays on, and also one Walnut chest and one side saddle and one linen wheel and my Will is that my sd Wife shall always be provided with one milch Cow to be Kept and provided for at the expence of my Sons William and Hugh during her natural Life, and my Will is also that if my sd Wife should die before me the said Legacies bequeathed to her Viz, the Feather Bed and furniture the Walnut Chest, the side saddle and Linen Wheel to be equally divided between my two Sons William & Hugh
Item I give and bequeath unto my Two Sons William & Hugh all the residue and remaining part of my Estate to be equally divided between them
Lastly I Constitute and appoint my two Sons William and Hugh sole executors of this my last Will and Testament revoking an annulling all other Wills by me heretofore made, ratifying and Confirming this and none other to be my last Will and Testament - In Testimony whereof I have hereunto set my Hand and seal this twenty first day of May seventeen Hundred and Eighty Nine
