Benjamin Hitt signed his will on April 14, 1861. He left all of his estate, after his debts and funeral expenses were paid, to his brother Henry Hitt in trust for his wife Sarah during her life or widowhood. At her death or marriage the executor is to sell all his estate and divide it equally among his children. His brother Henry Hitt is the executor.
On December 23, 1862 Henry L. Hitt renounced the executorship of the estate. On January 7, 1863 Wm. Austin, Isaac G. Austin, and B. L. Hitt were bound in the amount of $1500 to guarantee that William Austin would faithfully execute his duties as administrator. The estate was appraised by Benjamin L. Hitt, Henry Hitt, and Isaac G. Austin. A sale took place January 21, 1863. A mare sold for $180 and a colt for $53. The value of the remaining 48 items was relatively low.
In 1883 M. E. Babb submitted a petition to the Probate Court of Laurens Co. stating that he is the Clerk of the Court of Common Pleas of Laurens Co., that Benjamin Hitt died in 1862 leaving a will in which he appointed his brother H. L. Hitt to be executor, that H. L. Hitt renounced the office of executor, that in 1863 William Austin obtained letters of administration, that William Austin has died without having fully administered the estate, that the estate has been for some years without a representative, that said Benjamin Hitt is a son of William Hitt and Milly Hitt, deceased, that the estates of William Hitt and Milly Hitt cannot be legally settled unless the said Benjamin Hitt has a personal respresentative, and that the estate of Benjamin Hitt consists of personalty in the estate of William Hitt and Milly Hitt, dec'd and is worth about $100. The petitioner asks that he be granted letters of administration de bonis non.
