LAWSUIT and DEPOSITION:

The following is copied from Earl J. Hitt's database 'hitthaynie'. See notes under James's father John Hitt for more about the lawsuit.

On 7 June 1854, James was living in Lawrence County, Tennessee. On this date he was examined by John A. Tinnon, J.P. and gave his deposition as ordered by the Culpeper Chancery Court in the case of Jeffries vs. Joel Hitt. Some of his answers were as follows:

Question: State all you know in relation to the Estate left by your father, so far as your knowledge may throw any light upon the present Matters in controversy.
Answer: I do not know any fact touching the matters in controversy which may not more properly be included in my answers to the interrogatories hereinafter propounded; I had been absent from the state for some five years before my Father's death; I lived in the state of Mississippi and reached my Father's in Culpeper County, Virginia, on a visit, in June 1836 after the death of my father, which occurred in March or April previous; I remained only until September and I know but little about the matters in dispute; I am the son and the sixth child of John Hitt dec'd of Culpeper County, Virginia.

Question: How many children had the said John Hitt dec'd and what were their names?
Answer: He had seven children in all; six by his first wife, Frances, and one by his second wife Nancy; Those by the first wife were named Joel, Job, Joab, and James; Elizabeth & Mariam; The one by the second wife was named John R. Hitt.

The remainder of James' deposition was concerned with the value of his father's estate, any distributions made by Joel Hitt, Executor, and any debts owed by his father.
