Chapter V of SOUTHERN KITH AND KIN, Volume 1, "The Locketts" (Jewel Davis Scarborough, 1951) is devoted to Thomas Lockett III and his wife Judith Townes, and subsequent chapters are dedicated to their descendants. The following is on pages 38-39. It is followed by a discussion of who Judith's parents were.

2-1. Thomas Lockett III married Judith Townes (Towns). Many members of the family have insisted that Thomas Lockett married ELIZABETH Judith Townes, and still others have said that PERHAPS Thomas was married twice, first to Elizabeth, second to Judith. However, the only official records found refer to Judith Lockett, as the wife of Thomas Lockett III, and in his will Thomas refers to his wife as Judith. On June 26, 1773 Thomas Lockett and Judith, his wife, sold to Edward Johnson 400 acres of land in Chesterfield County on Nut Tree Branch (of Swift Creek) recorded in Chesterfield Deed Book 7, page 238. This land had been first patented by James Locket of Amelia on May 23, 1763 and had been sold by him to Thomas Lockett of Cumberland on June 28, 1767 (Chesterfield D.B. 6, pg 5O). Thomas Lockett's will is recorded in Cumberland Will Book 2, pg 165, in which he names his wife Judith and the following children: Stephen Lockett, Abner Lockett, Jacob Lockett, Martha Bass, Lucey Stone, Elizabeth Lockett, Mary Gipson (Gibson), James Lockett and David Lockett. Some family records name still another son, Osborne, but I have been unable to locate or identify him. Letters of Administration were allowed for the estate of Judith Lockett February 21, 1782 followed by an inventory and appraisal March 18, 1782 in Powhatan County, which gives us an approximate time of Judith's death.

Thomas Lockett III bought 200 acres on Butterwood Creek from his father (See State Land Office Patent Book 21, pg 95). The name given is Thomas Lockett Jr. He patented lands in Amelia County, the first being for 42 acres on the north side of the north fork of Falling Creek on July 30, 1742. On August 20, 1747 he patented 1531 acres on the north fork of Falling Creek and on Harris Creek (See State Land Office Patent Book 28, pg 167). By his father's will he inherited 200 acres on Falling Creek.

Butterwood Creek is in the southeastern corner of the present Powhatan County, near Skinquarter Creek, which separates Chesterfield from Powhatan. Falling Creek is in the western part of Prince Edward County and rises between the village of Prospect and the station Elam (both on the Norfolk and Western Railroad and U. S. Route 460) and flows in an easterly direction into Buffalo River, which is on the south side of the Appomattox River and flows into it at Farmville. Harris Creek rises on the north of the N. and W. Railroad. Falling Creek rises on the south and flows in a northerly direction into the Appomattox River. See John Wood's map of Prince Edward County, 1820.

On May 20, 1749 Thomas Lockett of Cumberland bought from Thomas Williamson of Amelia 400 acres on both sides of Harris Creek, adjoining the Lockett patent (Amelia D.B. 3, pg 223). On May 18, 1750 Thomas Lockett of Cumberland sold 690 acres on the north side of the north fork of Falling Creek to William Campbell. On November 10, 1747 Thomas Lockett was appointed by the Vestry, along with Richard Moseley and Francis Marshall, to procession the lands along the Appomattox River in Southam Parish, the present Powhatan County. These deeds and patents establish the place of residence of Thomas and Judith Lockett.

LAND:

On June 28, 1767 James Lockett of Amelia Co. sells to Thomas Lockett of Cumberland Co. for £80 a tract of 400 acres, more or less, in Chesterfield Co. lying on both sides of a branch of Swift Creek called Nutt Tree. It begins at a corner pine of Francis Flournoy's standing on the west side of a branch of Nutt Tree and is bounded by John James Flournoy's line. Signed James Lockett (L.S.) and Hanna Hawkins (her H mark) Lockett (L.S.). Two of the witnesses are Stephen Lockett and Abner Lockett. (Chesterfield Co. Deed Records 6/50) The seller is Thomas's son.

On June 26, 1773 Thomas Lockett & Judith, his wife, sell to Edward Johnson for £156 a tract of 400 acres in Chesterfield Co. on the south side of the James River. It begins at a corner pine of Frances Flournoy's on the west side of a branch of Nuttree and is the same tract granted to James Lockett by patent dated May 23, 1763. It adjoins John Jas. Flournoy. In the name of God Amen I Thomas Lockett of the county of Cumberland being sick and week of body but in perfect mind and memory do make and ordain this my last will and testament in manner and form following to wit;

Impremis I give and bequeath to my son Stephen Lockett all my land in Prince Edward county on the south side of Harrises creek to the main road to him and his heirs forever.

Item I give and bequeath to my son Abner Lockett the land where I now live to him and his heirs forever.

Item I give and bequeath to my son Jacob Lockett all my land on Nuttree branch in Chesterfield county to him and his heirs forever if he shall arrive to the age of twenty one years if not I desire the land to be sold to the highest bider and the money to be equally divided amongst all my children as also I give him fifteen pounds current money one feather bed and furniture a horse bridle and sadle of ten pounds value.

Item I give and bequeath to my daughter Martha Bass all my land on the north side of Harrises creek from the cross line of my son Stephen to the upper line to her and her heirs forever.

Item I give and bequeath to my daughter Lucey Stone all the land on the south side of the north fork of Falling creek as also twenty acres of the north side begining at the Cabbin line thence up the creek to include the twenty acres to her and her heirs forever.

Item I give and bequeath to my daughter Elezebeth Lockett one fether bed and furniture and fifteen pounds current money.

Item I give and bequeath to my daughter Mary Gipson one fether bed and furniture and fifteen pounds current money.

Item I give my well beloved wife Judith Lockett thirty pounds current money if she will relinquish her right of my estate. It is my desire that all the land I hold in Prince Edward county not already willed away be sold and the money equally divided amongst all my children except my son James Lockett. It is further my desire that all the rest of my estate of every nature and kind watsoever both real and personal be equally divided amongst all my children that is to say James Stephen David Abner and Jacob Lockett Martha Bass Lucey Stone Mary Gipson Elezebeth Lockett.

I also desire my estate may not be appraised.

And Lastly I do constitute and appoint my son Stephen Lockett Abner Lockett and Arthur Moseley Exec's of this my last will and testament hereby revoaking all other wills by me formerly made In witness whereof I have hereunto set my hand and affixed my seal this twenty eight day of September Anno dom'ii, one thousand seven hundred and seventy.

At a court held for Cumberland county the 23rd January 1775.
This last will and testament of Thomas Lockett deceased was exhibited in court by Stephen Lockett and Abner Lockett two of the executors therein named and the same was proved by Gideon Lockett and Robert Haskins two of the witnesses thereto and ordered to be recorded and on the motion of the said executors who made oath according to law certificate is granted them for obtaining a probat thereof in due form giving security whereupon they together with Arthur Moseley and Gideon Lockett their securitys entered into bond according to law and liberty is reserved to the other executor to join in probat.

I have put the children in the order in which they appear in the will -- 5 boys followed by 4 girls. If there ever was a child named Osborne, he was dead by the time his father wrote his will. 58. Thomas Lockett was born in Henrico, Virginia 1700. Thomas died 1775 in Cumberland Co., Virginia. He married Elizabeth Judith Townes in Goochland County, Virginia, 1730.

Thomas Lockett III and Elizabeth Judith Townes had the following children:

59 i. James Lockett was born in Goochland, Virginia 1731. He married Hannah Hawkins Lewellen in Virginia. Inheritance: No land! Only a share of remaining real and personal property.

60 ii. Stephen Lockett was born in Goochland County, Virginia 14 November 1733. Stephen died 14 September 1794 in Prince Edward Co., Virginia, at 60 years of age. He married Mary Clay 20 October 1760. His home, "Elmwood" on Sailors Creek, Prince Edward Co., Va. stands today.

49 iii. David Lockett was born 1735.

61 iv. Osborne Lockett was born in Goochland, Virginia 1736. Inheritance: Not mentioned in Thomas Lockett III's will. Must have preceded father in death.

62 v. Martha Lockett was born in Goochland, Virginia 1739. She married Alexander Bass in Chesterfield, Virginia, 1775. Moved to Wilkes County, Ga. mid-1780's. Inheritance: All the land on the north side of Harris Creek from the crop line of Stephan Lockett to the upper line. In 1774 Thomas Lockett III sold to Alexander Bass (Martha's husband) 250 acres in Prince Edward County. Deed Book 5, p. 358.

63 vi. Elizabeth Lockett was born in Goochland, Virginia 1741. Inheritance: One feather bed, furniture, and fifteen pounds current money.

64 vii. Abner Lockett was born in Goochland, Virginia 1743. Abner died 1790. He married Ann Marshall in Cumberland, Virginia. Inheritance: Land upon which Thomas Lockett III lived.

65 viii. Lucy Lockett was born in Goochland, Virginia 1745. She married William Stone in Cumberland, Virginia, 27 February 1767. Inheritance: All the land on the south side of the north fork of Falling Creek and twenty acres of the north side beginning at the Cabin line, thence up the creek to include the twenty acres. In 1774 Thomas Lockett III sold to William Stone (Lucy's husband) 241 acres in Prince Edward County. Deed Book 5, p. 357.

66 ix. Mary Lockett was born in Goochland, Virginia 1747. She married John Gibson in Buckingham, Virginia. Inheritance: One feather bed, furniture, and fifteen pounds current money.

67 x. Jacob Lockett was born in Cumberland, Virginia 1749. He married Lucy Waddell in Chesterfield, Virginia, 12 March 1791. Inheritance: All the land on Nuttree branch in Chesterfield, Va., also fifteen pounds current money, one feather bed and furniture, a horse bridle and saddle of 10 pounds value. In 1775 brothers sold their portions of 200 acres on Falling Creek, Prince Edward County to Jacob Lockett. Deed Book 5, p. 432.
