Drury Sims signed his will in the presence of Lewis Ball, John Hitt, and Thomas Salmon on January 31, 1832. He leaves a large number of specific household items to his daughter Polly/Polley. He directs his executors Benjamin Maldin and Richard Sims to sell all remaining property, real and personal, after his death and to divide it equally among all his children. He directs that $120.81 1/4 be deducted from the share of his son Drurey "for money paid for him by me". He further states that he wants the living children of Abner Hitt, dec'd, to have the share of the estate that would have fallen to their mother and that it be equally divided among them.

The will was proved November 29, 1839 by the oath of Lewis Ball. Richard Sims was the administrator of the estate.

David Owen, Benjamin Hitt, and Lewis Ball appraised the estate. There was a sale December 13, 1839.

Henry Hitt bought 1 item; total $1.00
Benjamin Hitt bought 22 items; total $26.18 3/4
William Hitt bought 4 items; total $2.18 3/4
Jesse Hitt bought 8 items; total $14.87 1/2
John Sims bought 4 items; total $24.56 3/4
William Hitt (preacher) bought 1 Negro man George ($550) and 1 coffee mill; total $550.12 1/2

Elizabeth Hitt bought 79 acres of land at $13.56 1/4 per acre ($1071.43 3/4) and 1 cow; total $1074.68 3/4
Richard Sims bought 1 item; total $.50
Lewis Ball bought 1 item; total $.37 1/2

Fourteen other buyers bought 24 items. Total proceeds of the sale were $1810.54 1/4.

On August 23, 1841 Richard Sims reported the distribution of assets to the legatees. $1590.89 3/4 was distributed to 8 legatees. "Each one's share" was $198.86. Then $120.81 was subtracted from Drury Sim's share, and one seventh of that amount ($17.26) was added to the other shares. Drury got $78.05 and the others got $216.12. Apart from Richard Sims the other legatees were not named.
