SWAYNE:

The following, slightly reformatted to improve readability, is from Byberry Waltons (Norman Walton Swayne, 1958), pgs 31-32:

49 BOAZ WALTON (4), born about 1737 in Byberry Twp, Phila. Co., Pa., died Aug. 2, 1823 aged 86 in Westmore1and Co., Pa., son of 7 Joseph Walton & Sarah, probably Roberts, of Byberry Twp, married 1st by license dated Dec. 24, 1762 at Swedes Church, Phila., Rebecca Leech, daughter of Toby Leech of 0xford Twp, married 2nd probably by 1767 Hannah Ashton, born about Nov. 7, 1745, daughter of Thomas Ashton of Phila. Co., who left a widow Rebecca, married 3rd at Swedes Church June 16, 1773, the same day as the date of the license, Mary Ashton, born Aug. 31, 1752, died Jan. 1, 1833 aged 80 yr 3 mo, daughter of the same Thomas Ashton.

In 1767 Phila. Orphans Court named Brewis (sic) Walton guardian for his infant son Obed whose mother Rebecca was daughter of Toby Leech. A writ in the same court in 1789 shows Thomas Ashton had a daughter Mary now Mary Walton, also a daughter Hannah now deceased, who married Boaz Walton and left children Rebecca, Hannah and Jesse. The Mervine Collection says Trinity Oxford Church has these baptismal records for daughters of Thomas & Rebecca Ashton: Hannah June 7, 1747 age 1 yr 7 mo; Mary Feb 19, 1753 age 5 mo 19 da. The above marriage of Mary at Swedes Church is from St. Michael's & Zion Lutheran Church of Phila.

Boaz is on the tax list of Bibury Twp 1769 for 70 acres 3 horses 3 cattle tax 9.4.0. These 70 acres had been part of his father's estate, deeded to Boaz Nov. 13, 1764 by brother Joseph, by Boaz & wife Mary Apr.6, 1776 to Joseph Hallowell for 500 pounds and by him 3rd mo 3rd 1783 to Jonathan Knight. These three deeds were recorded the same day in 1841.

Boaz moved, probably about the time he sold in Byberry, to Northampton Co., where May 5, 1787 Boaz of Penn Twp rec'd from Nicholas Waln of Phila. 199 acres on Mahoning Creek for 200 pounds. March 11, 1794 Boaz was warrantee of 200 acres in Northampton Co. and Apr. 23, 1808 Boaz of East Penn Twp & wife Mary deeded two tracts there to Andrew Heller of Lower Saucon Twp, that from Waln and one of 206 acres patented to Boaz Feb. 9, 1795, all for 1500 pounds. Heller gave a mortgage but failed to pay, so after some at least had been sold to Andrew Fritz, then to Thomas Walton, then to Lewis Enke in a barter, the sheriff sold it for debt. There can be little doubt this Thomas Walton of East Penn Twp, who held for a time land formerly owned by Boaz, and named his eldest son Boaz, was son of Boaz & Mary.

William Blose Reed says Daniel Blose's first mill was at a place known in 1939 as Oswald's Mill, near Best Station, about three miles west from Slatington, Pa., and the mill owned by Daniel Blose and Boaz Walton was in the Mahoning Valley west from Lehighton and later was known as Garber's Mills. The 1790 census says Boas Walton of Northampton Co. was head of a family of 2 males over 16, 5 under 16 and 7 females. There also was a family there headed by Jestha Walton, one male and one female. Boaz was witness Dec. 1790 to the will of Daniel Warner of Mahony Creek; Boa and Jesse the May 31, 1794 will of Henry Reinhard of Penn Twp; J. Walton was mentioned Oct. 31, 1793 in the will of Andrew Ledlie of Easton, possibly father of Jesse's wife. A11 three were Northampton Co. wills.

Pa. Archives say Boas 1778 2nd co. of 3rd batt. Northampton Co. militia 2nd class, 1780 Boaz 2nd co. of 6th batt. of same 2nd class. Tax lists of Penn Twp have 1785 Boas Watton 180 acres 2 horses 3 cattle tax 17.6, 1786 Baos Walton 210 acres 2 horses 3 cattle tax 17.0, 1788 Boaz 180 acres 2 horses 4 cattle tax 14.0.

Around the end of the century Boaz moved with most of his family to Westmoreland Co., Pa. The history of that county calls him Joseph, but correspondence with several descendants leaves no doubt it was Boaz. It says he was an early settler, took up 200 acres in what became Penn Twp, was exposed to savages who frequently visited his home, but was not molested. It names three children, Joseph, Boaz and Caroline, the last apparently an error, since no other mention of her has been found. William Blose Reed writes that Boaz Walton and Daniel Blose or Bloss owned adjoining lands in Northampton Co., which later were in Mahoning Twp, Carbon Co., and seem to have been closely associated through a good part of their lives, having been in the same battalion, if not the same company, during several years of the Revolution. The History of Jefferson Co., Pa. says "About 1790 Daniel Blose came to Westmoreland Co. with Boaz Walton, and he and his family lived in a round log house without any floor in it except the ground, with Boaz Walton and his family, about eight miles north of Greensburg. Daniel Blose, whose wife's name was Elizabeth, was the father of seven children: George, Michael, Barney, Mary married to Joseph Walton, Daniel, Ann married to Isaac Shuster and a daughter born 1783 whose name was Magdalena."

Of these George, Daniel and Magdalena, not Mary, were the ones who married Sarah, Martha and Joseph, children of Boaz Walton. C. L. Hugus, an attorney of Greensburg, who first sent dates of deaths of Boaz & Mary from their stones, and has helped in other ways, says they and several descendants lie in Denmark Manor Cemetery near there. The above History of Jefferson Co., in an article on George Blose, who married Sarah Walton, says her father Boaz Walton was twice married, that Obadiah and a brother whose name had been forgotten by the last of his sister's children, and perhaps a sister, were children of the lst marriage, that Mary Ashton was the 2nd wife and her children were Joseph, Sarah married George Blose, Mary married William Martz, Rachel married Peter Wagaman, Martha married Daniel Blose, Elizabeth married George Ament, Emily married Nicholas Martz, and Samuel. A release Jan. 14, 1832 by Mary Walton widow of Boaz, after letters in his estate were issued 28 Nov. 1823 in Westmoreland Co. to Boaz Walton Jr and Joseph Walton, has this list of children: Samuel, Rachel wife of Peter Waugaman, Elizabeth wife of George Amont, Amey or Amy wife of Nicholas Martz, Mary wife of William Martz, Sarah wife of George Blose, Martha wife of Daniel Blose, Boaz Jr and Joseph. Another release, found like the 1st in Mervine Coilection #86, dated Jan. 28, 1833 after the death of Mary, gives these children of Boaz Walton Sr of Franklin Twp, Westmoreland Twp: Boaz Jr, Joseph, Jesse, Asa B., Barzilla, Hannah married Joshua Davis. From these sources, this looks like at least 16 children, one by the lst wife, three by the 2nd and 12 by the 3rd. An attempt has been made to arrange these in order of birth, but data are not sufficient and several probably are out of order:

LAND in BYBERRY TOWNSHIP:

On November 13, 1764 Joseph Walton of Byberry Township and Barbara, his wife, sell to Boaz Walton, yeoman of the same place, for £320 a tract of 70 acres and 118 perches in Byberry Township. (Philadelphia Co. Deed Records Book GS26, page 218) On April 6, 1776 Boaz Walton, yeoman of Byberry Township, and Mary, his wife, sell the same tract to Joseph Hallowell of the City of Philadelphia for £500. (GS26/220) Then in 1783 Hallowell sells the same tract to Jonathan Knight for £545 (GS26/223). All 3 deeds were recorded March 15, 1841, they all contain the same complicated metes and bounds description of the tract, and they all contain a detailed recitation of the history of the tract. The last deed (GS26/223) has the most extensive historical description.

Nathaniel Walton in his will dated September 19, 1732 nominated Nathaniel Walton and Malachi Walton as his executors and authorized them to sell all of his estate, real and personal. The executors by indenture of lease and release dated December 11, 12, 1734 (F8/48) sold a tract of 150 acres out of a tract of 287 acres owned by Nathaniel Walton, deceased, to Joseph Walton. Joseph Walton died intestate and seized of this 150 acre tract in fee simple, and his son Joseph Walton purchased the 150 acre tract, now computed to contain 161 acres and 13 perches by a new survey, from the other heirs. More specifically, on November 8, 1764 Boaz Walton; Samuel Walton and Elizabeth, his wife; William Francis and Sarah, his wife; and Samuel Dungan and Elizabeth, his wife, sold to Joseph Walton a certain messuage plantation and tract of 161 acres and 13 perches situated in Byberry Township, subject to the yearly quitrent due to the Chief Lord or Lords of the fee and also subject to the dower or third of Sarah Walton, widow and relict of the said Joseph Walton, deceased, father of the parties to the transaction. Martha, the late daughter of Joseph Walton, deceased, is mentioned.

Five days later on November 13, 1764 Joseph Walton sold almost half of what he had just bought to his brother Boaz. Joseph and his wife Barbara acknowledged their deed December 12, 1764. It appears to me that the deed of November 8, 1764 was never recorded. Since Joseph Walton, son of Nathaniel, is said to have owned the 150 acre tract in fee simple, I do not understand why it was subject to a yearly quitrent. The description of the November 8, 1764 deed which is in the November 13, 1764 deed indicates that Sarah, widow of Joseph Walton, was alive on November 8, 1764. In the April 6, 1776 deed to Joseph Hallowell the seller, Boaz Walton, promises to defend the buyer's title against any claims arising from his mother's dower rights. It thus appears that Sarah, widow of Joseph Walton, was alive in April, 1776 since dower is a life estate.

DEATH DATE:

The date on the tombstone (1825) contradicts the claim in Swayne that letters of administration were issued in 1823.
