General:
In a petition submitted to the December 1867 term of the St. Louis Probate Court, W. H. Lackland, administrator de bonis non of the estate of Joseph Walton, dec'd, says that he was induced to take charge of the estate for the purpose of enforcing certain legacies due Nancy, Robert, Samuel, Julia, Eliza, Joseph, and George Walton.
According to Joseph Walton's will, his grandson Robert was to receive $1000 when he became 21 and the other children of Joseph's son George Walton were to share $1000. Those other children are not named in the will. W. H. Lackland became administator de bonis non in or before September 1863. Julia, Eliza, Joseph, and George in the above list are children of George Walton, dec'd, in order of age. Eldridge, another son of George Walton, dec'd, is in the 1860 census. Since he is not in the list, one could reasonably assume that he died before September 1863. In fact he died in October 1864 in the battle of Allatoona Pass. Presumably at the time W. H. Lackland was appointed administrator de bonis non, he was responsible for enforcing a legacy to Eldridge as well, but by 1867 that responsibility was moot and hence he did not mention Eldridge.
On October 28, 1862 Anne Walton, wife of Joseph Walton, listed George's children in her will as Julia, Eliza, Elverton, and Joseph. Why is George missing? Are Elverton and Eldridge the same person?
CIVIL WAR:
In "The Roster of Union Soldiers 1861-1865" for Illinois Robert M. Walton and Eldridge Walton are both in the 7th Infantry Company F, and Robert is a corporal. The 7th Infantry was organized at Springfield from July to December, 1861 to serve for 3 years.
According to "Find a Grave" Eldrige was killed October 5, 1864 in the battle of Allatoona Pass and is buried in the Marietta National Cemetery, Cobb Co., Georgia, Plot C-2028. He was a private. He joined Febuary 20, 1864 at Springfield for a period of 3 years and was mustered in at Camp Butler, near Springfield, on Febuary 23.
