Notes
General:
The following, slightly reformatted to improve readability, is from Byberry Waltons (Norman Walton Swayne, 1958), pgs 21-22:
27 JOSHUA WALTON (3), died 1759, son of 4 Daniel Walton & Mary Lamb of Byberry Twp, Phila. Co., Pa., married by 8th mo 1716 Cassandra or Catharine Albertson, died by 1759, daughter of William Albertson & Hannah Druit. The History of Byberry and Moreland says she was known as Case Walton, although it gives her name as Catharine. Case sounds more like Cassandra, which is the name given in Colonial and Revolutionary Families, where her parents are named. The above history says Catharine died 12th mo 18th 1759, but the fact that Isaac Comly's obituary notes give that exact date for the death of their daughter Cassandra, and the absence of any wife in Joshua's will, which named seven children, make that date seem unlikely.
Joshua committed suicide by hanging from a tree in front of his house, and was buried in one of his back fields. The history says the place was supposed haunted for many years after. The will of Joshua Whalton of Buyberry, drawn Nov. 3, 1755, proved July 27, 1759 in Phila., was hard to find on account of spelling. It named the eight children below except Jane, left 176 acres in Warminster Twp next Adrian Scoutt and Joseph Hart to eldest son Jonathan Whalton, and all the plantation in Buyberry where I now dwell, rec'd of Samuel Swift and Thomas Duffield, next Samuel Swift and Rachel Pert, to son Joshua.
According to a minute of Abington Mtg 8th mo 29th 1716, Joshua & Catharine were married by a Justice of ye Peace. An effort to get them to acknowledge their error failed, although Jeremiah Walton son of William and Daniel Walton son of Daniel, both of whom had attended this wedding "contrary to Friends' orders", condemned their parts in it at the next monthly meeting. About eight years later the minutes of 7th mo 28th 1724 say "Whereas Joshua Some years ago & his Wife being Educated both among Friends did Accomplish their Marriage out of Unity, and Friends having a Care in bringing them both to a Sense of their going a wrong way to finish their Marriage, two friends are appointed to deal with them." Not long after a paper was read at the meeting of 5th mo 26th 1725 acknowledging their error, and this was accepted. 9.18.1758 the minutes say Byberry complains of Joshua for drinking to excess and 2.26.1759 Joshua Senr was reported disowned.
3 Dec. 1760 the heirs of Joshua Walton of Bibuary granted 166 acres in Warminster Twp next Jonathan Walton, to eldest son Jonathan Walton, to whom Joshua had willed it. The five heirs who signed, with husbands of two, were son Joshua, son Albinson, daughter Elizabeth wife of Richard Thomas of Hilltown, Bucks Co., daughter Hannah Shearman and daughter Ann Walton. Since drawing and before signing Hannah had married John Horn of Buckingham Twp, so they signed John Horn and Hannah Horn. The order of the eight children may have been about as follows:
74 Elizabeth d ab 1785 m 1736 Richard Thomas d by 1776
75 Cassandra d 1759 not married
76 Jonathan d 1790 not married
77 Albertson b 1731 d 1821 m 1755 Rachel Britton b 1736 d 1822
78 Hannah m 1st a Sherman d by 1760, m 2nd 1760 John Horn
79 Joshua d 1773 m 1761 Jane Wessel or Wyrel or Wassell
