"1731, Sept. 20. Hinds, James, of Elizabeth Town, Essex Co, yeoman; will of. Daughters, Mary and Deborah, large silver tankard, marked I. D. H. upon lid. Daughter, Elizabeth, four silver spoons marked I. A. H. Daughter, Patience, silver tumbler with a French crown on the bottom and marked I. D. H. at 18 years. Daughter, Sarah, three silver spoons marked I. A. H. at 18 years. Sons---James, John and Joseph. Land joining lands of Thomas Clark, which I purchased of Ephraim Clark; lands purchased of Ebenezer Lyon, Deborah Moris, Richard Higens, and Edward Spining; land joining land of Samuel Marsh, purchased of Will. Oliver. No lands to be sold until sons come to 26 years. Son, John, my great Bible. Executors--son, James, and friends John Spining and Ebenezer Johnson. TEXT of WILL:
The will of "James hinds of Elizabeth town in ye County of Essex and province of New Jersey yoeman" was signed on the twenty fourth day of September, 1731. The witnesses were Richard Higens, Deborah Moris, and Edward Spining. It can be seen in the Essex Co., New Jersey Probate Records at FamilySearch.org, "Probate records, 1697-1900", 395G-1140G, film #545456, images 161-166/772. The handwriting is really hard to read. I have in general tried to preserve the original spelling and punctuation. However, three words in particular (purchased, Patience, and piece) are spelled strangely in more than one way, and I have used modern spelling. I have introduced paragraphing. After the usual verbiage about being weak in body but of sound mind, paying just debts, a Christian burial, etc., the text of the will is as follows. The missing word in the fifth item may be 'Wif'. However, it would be strange not to mention the wife first and to bequeath to her just one object. Note that this bequest is missing from the above summary. Note also that the stipulation that the sons not sell their land before attaining the age of 26 applies only to John and Joseph.

17 Aug 1722 -- The wife is the sole executrix of the estate of Joseph Marsh of Elizabeth Town, Essex Co., with James Hindes and Joseph Tooker as overseers. (Vol XXIII, pg 305, image 396/753)

James Hindes is a witness to the July 19, 1705 will of Benoni Lee, a brother of James's probable wife Mary Lee. See notes under Benoni Lee.
The 1731 will of James Hinds mentions 3 sons and 5 daughters. A facsimile copy of the will is hard to read. It may mention a wife named _annah. If so, she receives just one object (a silver _____). The 1705 will of Benoni Lee makes it clear that his sister Mary is married to a man with surname 'Hindes'. A process of elimination suggests, but does not prove, that Mary's husband was the James Hinds who died in 1731. In 1705 she has 3 sons and a daughter. She may or may not be the mother of all of James Hind's children.

The 1705 will of indicates that his sister was married to some man with surname Hinds. But which one?
Mary was born in the 20 years or so after her parents were married, 1676-1696. The two coopers and are improbably old. The normal expectation is that they would have had several sons, but the only son of whom we have a record is James's son , who died in 1731. A 13 Mar 1689 deed indicates that James Hinds the father lived close to Thomas Lee. In his will James (-1731) mentions 3 sons, James, John, and Joseph. In 1731, John and Joseph were not yet 26, thus born after 1705, and James was probably born not long before 1705. Since Mary was married and had children in 1705, these 3 sons are much too young to be her husband.
If Mary Lee is the wife of the James Hinds who died in 1731, she is the mother of James, John, and Joseph. That is problematic because Bennone's 1705 will implies that James is her third son and that he has an older brother Jonathan. However, remember that 26 years have passed between 1705 and 1731. It is plausible that in that period of time Jonathan and another brother died, making James the eldest surviving son.
